Constitutional Foundations of the Right to Freedom in Azerbaijan
Abstract
The article explores the content and structure of the constitutional and legal regulation of the right to freedom in the Republic of Azerbaijan. The objective of the research is to identify the key guarantees of personal liberty enshrined in the Constitution and to analyze their compliance with international human rights standards.
Scientific novelty lies in the systematic consideration of the right to freedom as a complex legal concept that includes personal inviolability, freedom of movement, and the prohibition of discrimination. Special attention is paid to the interaction between national and international norms, the direct applicability of constitutional provisions, and the role of judicial and institutional protection. Scientific result shows that the Constitution of the Republic of Azerbaijan and relevant legislation provide a stable legal framework for safeguarding individual freedom. The paper highlights the conditions for permissible restrictions, legal procedures, the principle of proportionality, and the rules that cannot be derogated from, even in states of emergency.
Practical significance lies in the potential application of the findings in law-making, constitutional jurisprudence, the activities of the Ombudsman, and in legal education for training professionals in public law.
