International Foundations of Intellectual Property Rights Protection

Abstract. The international foundations of intellectual property rights protection are based on a system of normative and legal mechanisms that ensure the legal protection of the results of creative activity at the global level. The main goal in this area is to protect the interests of authors, inventors and other right holders, as well as to create conditions for the promotion of innovations and the development of international trade. The World Intellectual Property Organization plays an important role in the formation of the international legal framework. Documents such as the Berne Convention and the Paris Convention adopted under the auspices of this organization define the basic principles of copyright and industrial property protection. In addition, the TRIPS Agreement adopted within the framework of the World Trade Organization establishes minimum standards for member states, linking the protection of intellectual property rights with the international trading system. These mechanisms ensure mutual recognition of rights, the principle of national treatment and the application of effective remedies against infringements. As a result, the international legal framework both protects the interests of right holders and contributes to the development of technology transfer and knowledge exchange.
