TÜRKİYƏ CİNAYƏT HÜQUQUNDA İNSAN ORQAN VƏ TOXUMALARININ ALQI-SATQISI

Dünya ölkələri qanuni olmayan üsullarla həyata keçirilən, hüquqa zidd olan orqan transplantasiyalarının qarşısını almaq üçün daxili hüquq sistemlərində müxtəlif tədbirlər görmüşlər. Bütün bu tədbirlərin təməlində var olan səbəblərdən biri qanunsuz yollarla həyata keçirilən orqan transplantasiyalarının səbəb olduğu insan hüquqlarının pozulmasının qarşısını almaq ikən, digər səbəb bütün dünyada önəmli problem olan orqan qıtlığı və bu qıtlığın səbəb olduğu orqan ticarəti cinayəti ilə təsirli şəkildə mübarizə aparmaqdır. Bu səbəbdən, əksər ölkələr hüquqa zidd olaraq edilən, eləcə də maddi gəlir əldə etmək məqsədilə donordan orqan götürülməsini təmin edilməsini cinayət hesab edərək, cəzalar müəyyənləşdirmişdir. Bu ölkələrdən biri də Türkiyə olub, Türk Cəza Qanununda bu əməli “orqan və toxuma ticarəti” adı altında sanksiyalaşdırmışdır.

Qeyd etmək lazımdır ki, Türk hüquq sistemində orqan və toxuma köçürülməsini tənzimləyən təməl qanun 1979-cu ildə qəbul edilən 2238 sayılı “Orqan və toxuma əldə edilməsi, saxlanması, peyvəndlənməsi və köçürülməsi haqqında” Qanundur. Bu Qanun canlı şəxslərdən və meyitdən orqan və toxumaların götürülməsinin şərtlərini tənzimləməklə bərabər, həmçinin Qanunun tələblərini pozan şəxslərə qarşı cəza tətbiq edilməsini də müəyyənləşdirir. Sözügedən Qanuna əsaslanaraq Türkiyə Səhiyyə Nazirliyi tərəfindən qəbul edilən “Orqan və Toxumaların Transplantasiyası Xidmətləri” Qaydaları transplantasiyanı həyata keçirəcək olan mərkəzlərlə, toxumalarla işləyəcək labaratoriyaların açılması, çalışması, eləcə də orqan və toxumaların köçürülməsi xidmətlərinin həyata keçirilməsi zamanı riayət edilməli olan üsul və qaydaları tənzimləyir. Türk Cəza Qanunun 91,92,93-cü maddələri isə insan orqan və toxumalarının qanunsuz transplantasiyasına, orqan və toxumaların ticarətinə dair məsuliyyəti və məsuliyyətdən azadetməni ehtiva edir. Məqalədə Türk Cəza Qanunun 91-ci maddəsində qeyd edilən əməllər ayrı-ayrılıqda təhlil edilməyə çalışılacaqdır.

Trafficking of human organs and tissues in criminal law of Turkey

Abstract

Countries around the world have taken various measures in their domestic legal systems to prevent illegal organ transplants. One of the reasons behind all these measures is to prevent human rights violations caused by illegal organ transplants, while the other reason is to effectively fight the worldwide problem of organ shortage and the crime of organ trafficking caused by this shortage. For this reason, most countries have defined punishments, considering it a crime to take organs from a donor, which is done against the law, as well as for the purpose of obtaining financial income. One of these countries is Turkey, which has sanctioned this act under the name of "trafficking of organs and tissues" in the Turkish Penal Code. It should be noted that the basic law regulating organ and tissue transplantation in the Turkish legal system is the Law No. 2238 "On the Acquisition, Storage, Vaccination and Transplantation of Organs and Tissues" adopted in 1979. In addition to regulating the conditions for the removal of organs and tissues from living persons and corpses, this Law also defines penalties for those who violate the requirements of the Law. The "Organ and Tissue Transplantation Services" Regulations adopted by the Ministry of Health of Turkey on the basis of the mentioned Law regulate the methods and rules to be followed during the opening and operation of the laboratories that will work with the tissues and the centers that will perform the transplantation, as well as the implementation of the organ and tissue transplantation services. Articles 91, 92, and 93 of the Turkish Penal Code include liability and exemption from liability for illegal transplantation of human organs and tissues, trade in organs and tissues. In the article, the acts mentioned in Article 91 of the Turkish Criminal Law will be analyzed separately.
