GÖMRÜK TARİF MÜNASİBƏTLƏRİNİN TƏNZİMLƏNMƏSİNDƏ HÜQUQİ PROBLEMLƏR

Müasir dövrdə tariflərin tənzimlənməsinin istehsalın inkişafına təsirini araşdırmaq çox vacibdir. Dünya miqyasında dövlətlər tariflərin tənzimlənməsinin faydalarını tanıyır və bu tədbirləri qlobal iqtisadiyyatın idarə olunmasında mühüm əhəmiyyət kəsb edir. Tədqiqatlar göstərir ki, beynəlxalq ticarətin ilk üç oyunçusu ‒ ABŞ, Yaponiya və Avropa İttifaqı tariflərin tənzimlənməsindən geniş şəkildə istifadə edir. İqtisadi cəhətdən güclü və inkişaf etmiş dövlətlər tarif tənzimlənməsindən yerli istehsalı gücləndirmək üçün mühüm alət kimi istifadə etdikdə, bu məsələnin əhəmiyyəti daha aydın görünür. Gömrük tarifi münasibətlərinin tənzimlənməsində beynəlxalq hüquqi problemlər müasir qlobal ticarət idarəçiliyində çoxşaxəli problemlər yaradır. Bu məsələlərin əsasında milli suverenlik və beynəlxalq əməkdaşlıq arasındakı gərginlik dayanır. Millətlər yerli sənayeləri tariflər vasitəsilə qorumağa çalışır, lakin bu, ədalətli ticarət təcrübələri ilə bağlı mübahisələrə səbəb ola bilər və iqtisadi inteqrasiya səylərinə mane ola bilər. Əhəmiyyətli problemlərdən biri müxtəlif hüquq sistemləri və ticarət müqavilələri arasında gömrük qaydalarının uyğunlaşdırılmasıdır. Tarif təsnifatlarında və qiymətləndirmə metodologiyalarında uyğunsuzluqlar tez-tez yaranır və bu, ticarət danışıqlarını və icrası çətinləşdirir. Bundan əlavə, güzəştli ticarət sazişlərinin yayılması bu mürəkkəbliyi daha da artırır, çünki müxtəlif mənşə qaydaları və tarif cədvəlləri parçalanmış ticarət mənzərəsi yaradır. Tarif tədbirləri ilə bağlı mübahisələr tez-tez ticarət qaydalarının ziddiyyətli şərhlərinin həll edilməli olduğu Ümumdünya Ticarət Təşkilatı (ÜTT) kimi beynəlxalq forumlara yol tapır.

Legal Problems in Regulating Customs Tariff Relations

Abstract

In modern times, it is very important to study the effect of tariff regulation on the development of production. States around the world recognize the benefits of tariff regulation and consider these measures to be important in managing the global economy. Research shows that the top three players in international trade - the United States, Japan and the European Union ‒ make extensive use of tariff regulation. The importance of this issue becomes more evident when economically strong and developed countries use tariff regulation as an important tool to strengthen domestic production. International legal problems in the regulation of customs tariff relations create multifaceted problems in modern global trade management. Underlying these issues is the tension between national sovereignty and international cooperation. Nations try to protect domestic industries through tariffs, but this can lead to disputes over fair trade practices and hamper efforts at economic integration. One of the important challenges is the harmonization of customs rules between different legal systems and trade agreements. Inconsistencies in tariff classifications and valuation methodologies often arise, complicating trade negotiations and enforcement. Furthermore, the proliferation of preferential trade agreements adds to this complexity, as different rules of origin and tariff schedules create a fragmented trade landscape. Disputes over tariff measures often find their way to international forums such as the World Trade Organization (WTO), where conflicting interpretations of trade rules must be resolved. However, the effectiveness of these mechanisms depends on the willingness of member states to comply with their decisions.
