TƏRCÜMƏ PROBLEMLƏRİ

Təqdim edilən məqalədə ispan dilində hüquqi mətnlərin tərcüməsində mədəni xüsusiyyətlərin əsas rolunu və işlənən terminlərin dəqiq verilməsinin əhəmiyyətini vurğulayacağıq. Hər bir ölkənin hüquq sisteminə xas olan termin və anlayışlarla dolu rəsmi dildə hazırlanan hüquq sahəsinə aid mətinlərin tərcüməsi çətin və həssas bir işdir. Məxəz və hədəf dillərin yaxşı mənimsənilməsindən əlavə olaraq tərcüməçilər sənədlərin təfsirinə təsir göstərə biləcək mədəni fərqlərdən məlumatlı olmalıdırlar. Bu mədəni fərqlər hüquqi terminlərin işlədilməsinə, sosial normalara və dəyərlərə təsir göstərə bilər. Bu sahədə tərcümənin mədəni səriştənin əsas olduğu sahələrdən biri də konkret hüquqi terminlərin şərhidir. Aparılan araşdırmalardan belə qənaətə gəlirik ki, dünyadakı hər bir hüquq sistemi, digər dillərdə birbaşa uyğun olmayan bənzərsiz bir sıra termin və anlayışlara malikdir. Burada tərcüməçi yalnız dil baxımından uyğun bir söz və ya sahə terminini düzgün tapmaq problemi ilə qarşılaşmır, həm də hüquqi terminin əsas məqsədini ölkəsinin mədəni və hüquqi kontekstində dəqiq şəkildə tərcümə etməyi bacarmalıdır.
Hüquqi mətnin dili hüquqşünasların ifadə etdiyi dillə yanaşı həmin sahənin bir çox xüsusiyyətlərini təmsil edir. Hüquqi terminlər yalnız hüquq sistemin özü tərəfindən müəyyən edilmiş sosial-mədəni məzmunu təmsil etmir.

Translation problems of cultural characteristics of Spanish legal texts
Abstract
In the article presented, we will highlight the fundamental role of cultural characteristics in the translation of legal documents in spanish language and the importance of the accurate using of terms in legal texts. Translation of legal texts written in the official language, full of terms and concepts specific to the legal system of each country, is a difficult and sensitive task. In addition to good mastery of the source and target languages, translators must be aware of cultural differences that can affect the interpretation of documents. These cultural differences can affect the values of legal terms, social norms and values. Interpretation of specific legal terms is one of the areas where cultural competence is essential for translation in this field. From the research carried, we conclude that every legal system in the world has a unique set of terms and concepts that do not correspond directly to other languages. Here, the translator not only faces the problem of correctly finding a linguistically appropriate word or field term, but must also be able to accurately translate the main purpose of the legal term into the cultural and legal context of his country.
The language of the legal text, along with the language expressed by lawyers, represents many features of that field. Legal terms represent not only the socio-cultural content defined by the legal system.
