MÜASİR DÜNYADA VƏ AZƏRBAYCANDA EKOLOJİ TƏHLÜKƏSİZLİK PROBLEMLƏRİ

Bu məqalədə “İnsan Haqları, Ədalət, Konstitusiya” başlığı altında “ətraf mühitdə yaşamaq hüququ” üzərində dayanmaq, bu hüququn konstitusiya mövqeyini qiymətləndirmək və mövcud konstitusiya müzakirələrindəki məsələlərə qısaca toxunmaq istərdim. İlk növbədə qeyd etmək istərdim ki, “insan hüquqları” müzakirələri ümumiyyətlə bu tərifin kontekstində aparılmır.

Şübhəsiz ki, belə bir müzakirə zəruridir və bu sahədə hüquq sistemimizdəki çatışmazlıqlar müasir ehtiyaclar nəzərə alınmaqla aradan qaldırılmalıdır. Tənqid etdiyim şey, insan haqlarını “təqsirləndirilənlərin hüquqları” ölçüsü ilə məhdudlaşdıran müzakirənin dayazlığıdır. Unudulmamalıdır ki, insan hüquqlarının da inkişafı və düzgün həyata keçirilməsi üçün əlverişli bir mühit yaradılmalıdır.

Environmental security problems in the modern world and in Azerbaijan

Abstract

In this article, under the heading “Human Rights, Justice, Constitution”, I would like to focus on the “right to live in the environment”, evaluate the constitutional position of this right and briefly touch upon the issues in the current constitutional debate.

First of all, I would like to note that discussions on “human rights” are not conducted in the context of this definition at all. Undoubtedly, such a discussion is necessary, and the shortcomings of our legal system in this area must be addressed, taking into account modern needs. What I criticize is the shallowness of the debate, which limits human rights to the “rights of the accused.” It should not be forgotten that a favorable environment must be created for the development and proper implementation of human rights.
