DAŞINMAZ ƏŞYANIN İPOTEKAYA QOYULMASI İLƏ BAĞLI SİSTEMLƏRİN MÜQAYİSƏLİ TƏHLİLİ

Məqalədə bir daşınmaz əşya üzərində birdən çox ipoteka hüququ olduqda sıranın müəyyən edilməsi zamanı iki fərqli sistem nəzərdən keçirilmişdir: irəliləmə və dərəcə sistemi. Bu iki sistemin ayrı-ayrı xüsusiyyətlərini araşdırmaqla hər birinin ipoteka saxlayanın və mülkiyyətçinin nə dərəcədə xeyrinə, yaxud ziyanına olduğu mövcud praktika və nəzəri yanaşmalar əsasında müəyyən edilmişdir. Azərbaycanın mülki hüququ üçün xarakterik olan irəliləmə sisteminin hansı səviyyədə qanunverciliyimizdə tənzim olunduğu, bu sistemdən kənara çıxmaların və irəliləmə sisteminin mülkiyyətçinin mənafeyinə hansı səviyyədə təsir göstərdiyi mövcud tənzimləmələrlə təhlil edilmişdir. Qanunvericilikdə irəliləmə sistemində nəzərdə tutulmayan mülkiyyətçinin sərəncam səlahiyyətinə hansı müdaxilənin olduğu araşdırılmışdır.

Comparative analysis of systems related to mortgage real estate
Abstract
The article considered two different systems for determining the order when there is more than one mortgage right on one immovable item. Progression and rank system. By examining the separate features of these two systems, it was determined on the basis of existing practice and theoretical approaches to the extent to which each of them benefits or harms the mortgage holder and owner. It was analyzed at what level the progress system is regulated in our legislation, which is characteristic of the Civil Law of Azerbaijan, and at what level the deviations from this system and the progress system have an impact on the interests of the owner. It was investigated what interference in the disposal authority of the owner, which is not provided for in the system of progress in the legislation.
