VƏKİL ARAŞDIRMASINDA XÜSUSİ BİLİKLƏRİN TƏTBİQİ MƏSƏLƏLƏRİ

“Vəkillər və vəkillər fəaliyyəti haqqında” Azərbaycan Respublikası Qanununun 15-ci maddəsi vəkillərin hüquqlarını tənzimləyir və ədalət mühakiməsinin əsas prinsiplərini müəyyən edir. Vəkillər müstəqillik prinsipinə uyğun olaraq qanunvericiliklə müəyyən edilmiş qaydada hüquqi yardım göstərmək, müştərilərini təmsil etmək və fəaliyyətlə məşğul olmaq hüququna malikdirlər. Onların peşəkar fəaliyyətləri zamanı müstəqil araşdırmalar aparmaq, sənədlər toplamaq, ekspert rəyləri almaq və texniki vasitələrdən istifadə etmək səlahiyyəti var. Onlar həmçinin daşınmaz əmlakın dövlət reyestrindən məlumat tələb etmək və qorunan şəxslə maneəsiz əlaqə saxlamaq hüququna malikdirlər. Hüquqşünaslar qanunvericiliyə uyğun olaraq, müştərilərini ən yaxşı şəkildə təmsil etmək üçün lazımi addımları ata bilərlər. Qanun qanunun aliliyini qorumaq və ədalətli hüquq sisteminin fəaliyyətini təmin etmək məqsədi daşıyır. Bu hüquqlar vəkillərə öz peşələrini etik dəyərlərə uyğun şəkildə həyata keçirməyə imkan verir. Azərbaycanda hüququn əsas prinsiplərini tənzimləyən bu maddə ədalətə və qanunun düzgün işləməsinə öz töhfəsini verir.

Issues of application of specialized knowledge in lawyer research
Abstract
Article 15 of the Law of the Republic of Azerbaijan "On Lawyers and Lawyers' Activity" regulates the rights of lawyers and defines the basic principles of justice. Lawyers have the right to provide legal assistance, represent their clients and engage in activities in accordance with the principle of independence, as determined by legislation. They have the authority to conduct independent research, collect documents, obtain expert opinions and use technical tools in the course of their professional activities. They also have the right to request information from the state register of immovable property and to have unhindered contact with the protected person. Lawyers can take the necessary steps to best represent their clients in accordance with the law. The law aims to protect the rule of law and ensure the functioning of a fair legal system. These rights allow lawyers to practice their profession in accordance with ethical values. This article, which regulates the basic principles of law in Azerbaijan, contributes to justice and the proper functioning of the law.
