AZƏRBAYCAN RESPUBLİKASININ QANUNVERİCİLİK SİSTEMİNDƏ İNTERNET VƏ İNFORMASİYA TEXNOLOGİYALARI SAHƏSİNDƏ YARANAN MÜNASİBƏTLƏRİ TƏNZİMLƏYƏN NORMATİV SƏNƏDLƏRİN TƏHLİLİ

İnternet yalnız informasiya mübadiləsi məkanı deyil, həmçinin dövlət idarəçiliyi, təhsil, səhiyyə, biznes və digər sahələri əhatə edən mühitdir. Azərbaycanın davamlı və dayanıqlı sosial-iqtisadi inkişafının təmin edilməsi, idarəçiliyin müasir prinsiplər əsasında həyata keçirilməsi məqsədilə informasiya və kommunikasiya texnologiyalarından istifadə olunması dövlət siyasətinin prioritetlərindən birinə çevrilmiş və bu sahədə mühüm addımlar atılmışdır. İnternetin inkişafı, internetdə fikir və söz azadlığı, sosial şəbəkələrin genişlənməsi qlobal şəbəkənin insanlara verdiyi yeni imkanlardır. Dövlətin sosial-iqtisadi və digər sahələrdə inkişafına nail olunmasında informasiya-kommunikasiya texnologiyalarından istifadənin müsbət tərəfləri və üstünlüklərinin olması ilə yanaşı bəzi risk və təhlükələri də vardır. Belə ki, insan hüquq və azadlıqlarının qorunması internet məkanında (kiber məkanda) və informasiya texnologiyalarından istifadə zamanı ən vacib və diqqətdə olan məsələlərdəndir. Bu məqsədlə yerli qanunvericilikdə internetdə və informasiya texnologiyalarının tətbiqi nəticəsində yaranan münasibətlərin, eləcə də bu münasibətlərdən əmələ gələn öhdəliklərin və məsuliyyətin müəyyən edilməsinə, tənzimlənməsinə xüsusi diqqət edilərək, mövcud normativ-hüquqi baza təhlil edilməli, boşluqlar aradan qaldırılmalı və təkmilləşdirilməlidir. Məqalədə toxunulan məsələ də məhz internet və informasiya texnologiyalarından istifadə və onların tətbiqi nəticəsində yaranan münasibətlərin tənzimləndiyi normativ sənədlərin təhlilini əhatə edir.

Analysis of normative documents regulating relations in the field of internet and information technologies in the legislative system of the Republic of Azerbaijan

Abstract

The Internet is not only a space for information exchange, but also an environment covering public administration, education, health, business and other fields. The use of information and communication technologies has become one of the priorities of the state policy to ensure sustainable and sustainable socio-economic development of Azerbaijan, to implement management based on modern principles, and important steps have been taken in this field. The development of the Internet, the freedom of opinion and speech on the Internet, and the expansion of social networks are new opportunities that the global network gives to people. In addition to the positive aspects and advantages of using information and communication technologies in achieving the development of the state in socio-economic and other fields, there are also some risks and dangers. Thus, the protection of human rights and freedoms is one of the most important and important issues in the internet space (cyberspace) and the use of information technologies. For this purpose, the existing normative-legal framework should be analyzed, gaps should be eliminated and improved, paying special attention to the determination and regulation of the relations arising as a result of the application of the Internet and information technologies, as well as the obligations and responsibilities arising from these relations. The issue touched upon in the article includes the analysis of normative documents regulating the relations arising as a result of the use and application of the Internet and information technologies.
