TİBB İŞÇİLƏRİ VƏ HƏKİMLƏRİN PANDEMİYA DÖVRÜNDƏ MÜALİCƏDƏN İMTİNA ETMƏK HÜQUQLARI

Tibb işçiləri və həkimlər qanunla onların üzərinə qoyulmuş vəzifələri yerinə yetirməklə yanaşı, həmçinin qanunda nəzərdə tutulan hüquqları həyata keçirə bilərlər. Etik çərçivədə tibb işçiləri və həkimlərin xəstələri müalicə etmək vəzifəsi zaman və məkan maneəsi tanımasa da, hüquqi cəhətdən bu belə deyil. Tibb işçisi və həkimlər qanunda göstərildiyi şərtlər daxilində müalicə etməkdən imtina etmək hüququna malikdir.

Bu məqalədə də tibb işçiləri və həkimlərin xəstələri müalicə etmək vəzifəsinin mahiyyəti, bu vəzifədən imtina etmək hüquqları və müxtəlif ölkələrin qanunvericiliyində bunun üçün nəzərdə tutulan şərtlər, eləcə də bu məsələnin Azərbaycan Respublikası qanunvericiliyindəki tənzimi məsələləri araşdırılacaq.

Rights of medical personnels and doctors to refuse treatment during a pandemic

Abstract

Medical workers and doctors, in addition to fulfilling the duties imposed on them by law, can also exercise the rights provided by law. Although the ethical duty of medical personnel and doctors to treat patients does not recognize time and space barriers, legally this is not the case. Medical personnel and doctors have the right to refuse treatment under the conditions specified by law.

In this article, the nature of the duty of medical workers and doctors to treat patients, the rights to refuse this duty and the conditions provided for in the legislation of different countries, as well as the regulation of this issue in the legislation of the Republic of Azerbaijan, will be examined.
