Bu məqalənin əsas mövzuları müqavilənin bağlanması üsulları, tərəflərin oferta və akseptlərinin xarakterik xüsusiyyətləri ilə bağlıdır. Təklif və qəbul şərtləri Mülki Məcəllənin bölmələrində müəyyən edilmişdir. Onların necə qarşılıqlı əlaqədə olduqları daöyrənilmişdir. Təklif müqavilənin imzalandığı anda edilən ofertadır. Təklif tərəflər arasında razılaşma nəticəsində qəbul edildiyi təqdirdə qəbul etibarlı sayılır. Təklifin qəbul edilməsinin, tərəflərin qanuni danışıqlar aparmaq və müqavilə bağlamaq qabiliyyətinin əsas elementlərindən biri qəbuldur. Müqavilənin şərtlərini şərh edərkən məhkəmə hər bir söz və ifadənin hərfi mənasına əlavə olaraq tərəflərin ifadə etdiyi iradənin həqiqi mənasını nəzərə alır. Bu, müqavilənin hərfi mənasını birləşdirilmiş bütün digər sözlər və mənalarla ziddiyyət təşkil edir.

Conclusion of contract. Offer and acceptance

Abstract

The ways to contract conclusion, as well as the parties’ proposals and acceptances, are the main topics of this article.The terms of the offer and acceptance are defined in the Civil Code sections. It has also been determined how they interact. The offer is that which is made at the time the contract is signed. The acceptance is established if the offer is accepted as a result of an understanding between the parties. One of the key elements in the proposal’s adoption, the parties’ ability to negotiate legally, and the contract’s conclusion is acceptance. The court considers the actual meaning of the will expressed by the parties when interpreting the contract’s terms of conclusion in addition to the literal meaning of each word and phrase. It contrasts the contract’s literal meaning with all other words and meanings combined.
