AZƏRBAYCANDA KİÇİK VƏ ORTA SAHİBKARLIĞIN İNKİŞAFI

Xülasə

Azərbaycanda kiçik və orta sahibkarlığın (bundan sonra – KOS) inkişafı iqtisadiyyatın diversifikasiyası, rəqabətqabiliyyətliliyinin artırılması, məşğulluğun təmin edilməsi, istehlak mallarına olan tələbatın yerli resurslar hesabına ödənilməsi və iqtisadi inkişafın təmin edilməsi baxımından xüsusi əhəmiyyət kəsb edir. Sahibkarlıqla bağlı münasibətlər mülkiyyət formasından, fəaliyyət növündən və sahəsindən asılı olmayaraq Azərbaycan Respublikasının Konstitusiyası, Azərbaycan Respublikasının dövlət müstəqilliyi haqqında Konstitusiya aktı, Azərbaycan Respublikasının iqtisadi müstəqilliyi haqqında Konstitusiya Qanunu, Azərbaycan Respublikasının Mülki Məcəlləsi, Sahibkarlıq sahəsində aparılan yoxlamaların tənzimlənməsi və sahibkarların maraqlarının müdafiəsi haqqında Azərbaycan Respublikasının Qanunu, bu Qanun və bunların əsasında qəbul edilmiş digər qanunvericilik aktları ilə tənzimlənir. Sahibkarlığın subyektləri.

Sahibkarlıqla Azərbaycan Respublikasının qanunvericilik aktlarında nəzərdə tutulmuş hallar istisna edilməklə aşağıdakılar məşğul ola bilərlər:

•     

•     fəaliyyət     qabiliyyəti olan Azərbaycan Respublikasının hər bir vətəndaşı;

      

•     mülkiyyət     formasından asılı olmayaraq hüquqi şəxslər;

      

•     hər     bir xarici vətəndaş və ya vətəndaşlığı olmayan şəxs;

      

•     xarici     hüquqi şəxslər.

Development of small and medium entrepreneurship in Azerbaijan

Abstract

The development of small and medium-sized enterprises (hereinafter - SMEs) in Azerbaijan is of particular importance in terms of diversification of the economy, increasing its competitiveness, providing employment, meeting the demand for consumer goods at the expense of local resources, and ensuring economic development. Relationships related to entrepreneurship, regardless of the form of ownership, type of activity and field, are governed by the Constitution of the Republic of Azerbaijan, the Constitutional Act on State Independence of the Republic of Azerbaijan, the Constitutional Law of the Republic of Azerbaijan on Economic Independence, the Civil Code of the Republic of Azerbaijan, the Law of the Republic of Azerbaijan on the Regulation of Inspections in the Field of Entrepreneurship and the Protection of the Interests of Entrepreneurs, is regulated by this Law and other legislative acts adopted on the basis of them. Subjects of entrepreneurship. The following can engage in entrepreneurship, with the exception of the cases provided for in the legislative acts of the Republic of Azerbaijan:

•     

•     every     citizen of the Republic of Azerbaijan who has the capacity to act;

      

•     legal     entities regardless of ownership form;

      

•     any     foreign national or stateless person;

      

•     foreign     legal entities.
