AZƏRBAYCAN RESPUBLİKASININ MÜLKİ PROSESSUAL QANUNVERİCİLİYİNDƏ PROSES İŞTİRAKÇILARININ HÜQUQİ VƏZİYYƏTİ


Xülasə

Tərəflərin anlayışını müəyyənləşdirmək problemi hüquq sahəsində mütəxəssislərin ən çox diqqətini cəlb edir ki, problemlərin özü çox genişdir, mübahisəli xarakter daşıyır və həm məhkəmə icraatının mahiyyəti, həm də iddia hüququ və iddia hüququ problemlərini əhatə edən bir sıra vacib sahələrə aiddir, iddia vermək hüququ, habelə mülki prosessual dispozitivlik aspektləri və s.

İddiaçı və cavabdehin prosessual hüquq və vəzifələrinin hüquqi mahiyyətini daha da araşdırmaq üçün mülki məhkəmə prosesində tərəflərin özlərinin anlayışına diqqət yetirəcəm (1).

Mülki Prosessual Məcəlləyə əsasən mülki prosesdə iştirak edən şəxslərdən başqa prosesdə iştirak edə bilən şahidlər, ekspertlərin, mütəxəssislərin, tərcüməçilərin, nümayəndələrin və vəkillərin hüquqi vəziyyəti müəyyən edilir (2).

İstinad ədəbiyyatında “tərəf”,”iddiaçı”, “cavabdeh” anlayışlarının tərifləri aşağıdakı kimi şərh olunur: “tərəf başqalarına qarşı olan şəxs və ya qrupdur”, “iddiaçı pozulmuş və ya mübahisəli hüququnu və ya qanunla qorunan marağını qorumaq üçün məhkəməyə, arbitraja və ya arbitraj məhkəməsinə müraciət edən şəxsdir”, “cavabdeh məhkəmədə baxılan mülki işin və ya arbitraj məhkəməsində baxılan İş mübahisəsinin tərəflərindən biridir”. Əlbəttə ki, bu təriflər yuxarıdakı anlayışların dərinliyini ortaya qoymur, buna görə də, şübhəsiz ki, tərəflər İnstitutunun inkişafına əvəzsiz töhfə verən Prosessual alimlərin əsərlərini nəzərdən keçirmək lazımdır (3).

In order to further examine the legal nature of the procedural rights and obligations of the plaintiff and the defendant, I will focus on the understanding of the parties themselves in civil proceedings.

According to the code of Civil Procedure, the legal status of witnesses, experts, specialists, translators, representatives and lawyers who may participate in the process other than persons participating in the civil process is determined.

In the reference literature, the definitions of the concepts of "party", "plaintiff", "defendant" are interpreted as follows: "a party is a person or group opposed to others", "a plaintiff is a person who applies to a court, arbitration or arbitration court to protect his violated or disputed right or interest protected by law", "the defendant is one of the parties to a civil case Of course, these definitions do not reveal the depth of the above concepts, therefore, undoubtedly, it is necessary to consider the works of procedural scientists who made an invaluable contribution to the development of the Institute of parties.
