İNSAN HÜQUQLARI HAQQINDA AVROPA KONVENSİYASININ 3-CÜ MADDƏSİNİN ÜMUMİ XARAKTERİSTİKASI

Avropa İnsan Hüquqları Konvensiyasının 3-cü maddəsi işgəncənin, qeyri-insani və ya ləyaqəti alçaldan rəftarın və ya cəzanın qadağan edilməsinə zəmanət verir. Əsas insan hüquq və azadlıqlarını qoruyan Konvensiyanın əsas maddələrindən biridir. 3-cü maddədə deyilir ki, heç kəs işgəncəyə və ya qəddar, qeyri-insani və ya ləyaqəti alçaldan rəftara və ya cəzaya məruz qala bilməz. Bu mühüm qayda insan hüquqlarının bölünməzliyini və universallığını müdafiə edir və onları fiziki və psixoloji zorakılığın bütün formalarından qoruyur. Bu maddə pozulduğu halda, şəxsin öz hüquqlarını qorumaq və təzminat almaq üçün Avropa İnsan Hüquqları Məhkəməsinə müraciət etmək hüququ var. Avropa İnsan Hüquqları Konvensiyasının 3-cü maddəsi insana qarşı işgəncə, qeyri-insani və ya ləyaqəti alçaldan rəftar və ya cəzanı qadağan edir. Məqalədə işgəncə və pis rəftardan müdafiə kontekstində dövlət və fərd arasında münasibətləri tənzimləyən əsas prinsiplər və normalar təsvir olunur.

Bu maddənin pozulması hallarına və Avropa insan hüquqları sistemi çərçivəsində insan hüquqlarının müdafiəsi mexanizmlərinə baxılır. 3-cü maddənin milli hüquq sistemlərində və hüquq-mühafizə praktikasında tətbiqi zamanı yaranan əsas problemlər və problemlər araşdırılır. İnsan hüquqlarının müdafiəsi üzrə bu beynəlxalq sənədin səmərəliliyi və inkişafının gələcək perspektivləri ümumiləşdirilmişdir.

General characteristics of Article 3 of the European convention on human rights

Abstract

Article 3 of the European Convention on Human Rights guarantees the prohibition of torture, inhuman or degrading treatment or punishment. It is one of the main articles of the Convention that protects fundamental human rights and freedoms. Article 3 states that no one shall be subjected to torture or cruel, inhuman, or degrading treatment or punishment. This important rule upholds the indivisibility and universality of human rights and protects them from all forms of physical and psychological violence. In case of violation of this article, a person has the right to apply to the European Court of Human Rights to protect his rights and receive compensation. Article 3 of the European Convention on Human Rights prohibits torture, inhuman or degrading treatment or punishment of a person. The article describes the basic principles and norms that govern the relationship between the state and the individual in the context of protection against torture and ill-treatment. Cases of violation of this article and mechanisms for the protection of human rights within the European human rights system are considered. The key problems and challenges that arise when applying are studied.

Article 3 in national legal systems and law enforcement practice is examined. The effectiveness and further prospects for the development of this international instrument for the protection of human rights are summed up.
