Tədqiqatda “köməksiz vəziyyət” anlayışı müxtəlif müəlliflərin nəzəriyyələrinə, eyni zamanda qüvvədə olan qanunvericiliyə, xarici ölkələrin qanunvericilik bazasına istinad edilərək nəzəri və praktiki cəhətdən ətraflı izah edilmişdir.

Zərərçəkmiş şəxsin yaş amilinin, yuxulu vəziyyətdə olmasının, sərxoşluq vəziyyətinin və digər amillərin hansı hallarda köməksiz vəziyyət hesab olunması ilə bağlı müəyyən edilmiş hüquqi və tibbi meyarlar cinayət hadisəsinin qiymətləndirilməsində mühüm rol oynayır və tədqiqatın əsas məzmununu təşkil edir. Eyni zamanda, tədqiqat qətl hadisəsinin və cəsəd üzərində ekspertizanın aparılmasında səlahiyyətli olan şəxsləri və ekspertiza prosesinin həyata keçirilməsi mərhələlərini ətraflı əhatə edir.

and expertise of the concept of “helpless situation”

Abstract

In the research, the concept of "helpless situation" was explained theoretically and practically in detail, referring to the opinions of various authors, the legislation in force at the same time, the legislative framework of foreign countries.

The established legal and medical criteria regarding the victim's age factor, sleepiness, drunkenness and other factors in which cases are considered a helpless situation play an important role in the evaluation of the crime scene and form the main content of the research. At the same time, the study covers in detail the persons responsible for conducting the homicide and autopsy and the stages of the autopsy process.
