DÖVLƏTƏ KEÇƏN GİZLİ “MİRAS”

Məqalədə sosial təminat hüququnun mühüm institutlarından hesab olunan pensiya təminatı hüququna toxunulmuşdur. Dövlətin həyata keçirdiyi başlıca sosial müdafiə tədbirlərindən olan pensiya təminatının vacibliyi vurğulanmışdır. Vətəndaşların pensiya hüququnun təmin olunduğu müddətdən əlavə, onların vəfatından sonrakı dövr üçün ailə üzvlərinin mənafeyinin müdafiəsi məsələləri qaldırılmışdır. Bu, xüsusilə aztəminatlı vətəndaşlar üçün mühüm əhəmiyyət kəsb edir. Məqalənin əsas mövzusu şəxs vəfat etdikdən sonrakı pensiya kapitalında qalan məbləğin dövlətə yox, varislik qaydasında şəxsin vərəsələrinə keçməsi ilə bağlı təklifi əhatə etmişdir. Göstərilən təklifin məqsədi əmək pensiyasını müxtəlif səbəblərdən qısamüddətli alan vətəndaşların hətta onların vəfatından sonrakı müddətdə ailə üzvlərinin maddi rifahını təmin etməkdən ibarətdir. Qanunvericilikdə belə tənzimləmələrin həyata keçirilməsi sosial dövlət üçün vacib addımlardan hesab edilməlidir.

Secret “inheritance” passed to the state

Abstract

The article deals with the right to pension provision, which is considered one of the important institutions of social security law. The importance of pension provision, which is one of the main social protection measures implemented by the state, was emphasized. In addition to the period when citizens' right to pension is ensured, the issues of protecting the interests of family members for the period after their death have been raised. This is especially important for low-income citizens. The main topic of the article covered the proposal that the amount remaining in the pension capital after a person's death should not be transferred to the state, but to the heirs of the person in the order of succession. The purpose of the given proposal is to ensure the financial well-being of the citizens who receive labor pension for various reasons even after their death. The implementation of such regulations in the legislation should be considered as one of the important steps for the social state.
